Does your former arrest and/or conviction qualify for expungement?

No Conviction

Individuals who were charged with crimes that did not result in a conviction (i.e. the case was dismissed, conditional discharge, pre-adjudication diversion program, acquittal/not guilty etc.), are eligible for expungement one year after the case was finalized.

Conviction

The expungement law also allows expungement of most criminal convictions, provided that the following conditions are met: 

(1) No other charge or proceeding is pending against the Petitioner
(2) Restitution, court costs, fines, and fees have been paid
(3) All requirements of the sentence have been completed
(4) No other criminal conviction has occurred for a certain time period, depending on the conviction being expunged 

Convictions that are NOT ELIGIBLE

The following convictions are not currently eligible for expungement in New Mexico:

(1) Crimes against children
(2) Offenses that cause great bodily harm or death
(3) Certain sex offenses
(4) Embezzlement
(5) DWI
